Hi,


I would like to use two prints coming from the archives of Bundesarchiv for a forthcoming article in a French magazine.

I was told that the copies and fees are prohibives.

Does anybody know the fees for using them ?

.. IIRC the fee you pay depends on circulation/copies printed. Really, it is not worth bothering with the BA, the fee you earn for your article won't even cover the cost of using 'their' images..and they always insist on a copy of the work the pics appear in. Not as expensive as the SHD though. My advice would be to look at other options first.

Hi.

I do not find the fees excessive.

For example would a fee for a photo reproduced in a magazine with 5000 copies produced cost approx 25 Euros, and for a publication with 25000 copies it is approx 35 Euros.

Afaik this fee give you a digital copy in print quality and the right to use it.

I do not know how much you get paid for writing such an article in France, but it is not unheard of that such a reproduction fee is covered by the publisher, and not the author.

All the Bundarchives photos are Public Domain (they have no copyright attached), so you are not required to pay a fee to use any of them.

According to Bundarchives directly:

All photos are licensed under the Attribution-ShareAlike 3.0 Germany (CC BY-SA 3.0).

You can:


Share — to copy, distribute and transmit the work

Remix — to adapt the work

Make commercial use of the work

Well, then it seems that the BA does not agree with the BA.

Do you have a direct information from the BA Koblenz that states that their photo collection can be used commercially without any fees whatsoever?

If that is the case Ill get in the car and go to Koblenz tomorrow morning and buy a few TB's of harddrives on the way.

Sure.
You can do that once but you end up on their black list and will not be able to order anything in the future!

All WW2 German photos, documents, handbooks and manuals were all released into Public Domain in 1945, due to the Enemy Property Act. Basically, previously copyrighted "WW2" items, lost copyright, as it was considered to be WW2 propoganda, etc.

If the BA is personally giving you access to their files, and they are investing time to research or find the photos you want, make prints, etc. then they can charge anything for those "services".

They released all their photos onto Wikimedia Commons, under the above noted license, as a cooperation / sharing project. This was done many years ago.

Read the license agreement at the bottom of this page:

This agreement allows anyone to copy, share, and distribute any of the photos, royalty free. You would just have to find the one you are looking for in Wikimedia to save yourself the "service" charges.

Just a question - if they as you say released all their photographs onto wikimedia, how dobyou search this site?

I have numerous references noted from my visits to Koblenz, but I cannot find them.

Also - when I search this site with keywords Bf 109 or Me 109 and Bundesarchiv I end up with about 40 results. I have seen hundreds of Bf 109 images in Koblenz. So yes, they may have uploaded a few images to the site, but it seems to be very far from the entire collection.

As to the copyright discussion and BA. It pops up now and then with especially US and UK based voices pointing at this Enemy Property Act, but it does not seem to have any effect whatsoever - the simple fact is that the original material is at the BA, and they call the shots with regards to access and usage.

The BA cannot control the use of the images...they lost all copyrights in 1945...and that is the law. But...they can control who they provide their services to, and what they charge for their services.

Use "-"...so Me-109, anstead of Me109, for example...you will see over 500 images.
