And thats the point what you go wrong. In germany you CANT buy the copyright. Only the photograph or the lawfuly heirs have this rights for publishing. Only this peoples can give the ok for publishing. The publisher get no rights.
When you buy a german photo at ebay and you don't know the copyright holder, you cant publish the photos with rights. What you not got you cant fight. Its easy.
Example: An author buy a photo for xxx $ at ebay from a trader. The author dont know the copyright holder (Urheber). He publish this photo somewhere. An other people copy this photo from his publication and do what ever with it. The author has no chance to win a fight for the rights, because he is not the lawfuly copyright holder.
And btw, if a photo has lost his german copyright protection (25, 50 or 70 years), it will be free to use for all. If someone pay for a free item, what he is? He has to much money or he is stupid.
