Indeed it is possible to see a tiny hint of a G (its registration) in the photo, so I am with you with regard to it being an impressed aircraft.
Also admit I was too lazy to start and try to track it down....

PS: Checking my French sources for the C.870 they say both were evacuated to Orleans-Bricy on 9 June 1940 and where No 01 was captured by the Germans. No 02 was moved to Biarritz where it was found in 1941. So far only No 01 seems to have been confirmed in use by Luftwaffe
