this is an Avia FL.3, an italian 2-seat trainer in use by the Luftwaffe.

Not only is the type above a single seat, if you compare the tails of the AVIA Fl.3 here with the tail of the type linked above, you can see that they are different types...

It actually appears to be a Nardi FN 305, which according to Chuck "Acree" over on the LEMB, a rare single seat version of the FN 305... more details here...

I think so, too. The Bü 180 had a straight wing, while this DK+ZW features the typical "gull" wing of the Kl 35. Plus, there is the Klemm company sign, right aft of the boot emblem.
